WPA 7906 of 2025 (Sabibrata Roy vs. State of West Bengal & Ors.) Mr. Soumya Nag Mr. Aditya Tiwari Ms. Namrata Chatterjee Mr. Mayukh Majumder .... For the Petitioner Ms. Sabnam De Barman Ms. Kakali Naskar .... For the State Reports submitted by the State are taken on record. Reports indicate that an amount of about Rs.4,29,578/- was siphoned from the petitioner's bank account with the ICICI Bank, Chetla Branch on 12th December, 2024 and a complaint was promptly lodged by the petitioner on 13th December, 2024. Despite the same, the FIR was registered on 17th January, 2025. The report reveals that the account numbers of the beneficiaries have been traced out. It is not known why the said beneficiaries/ accused have not been booked as yet. Investigation has been continuing for almost a year with no visible progress. The investigating agency has taken the assistance of Cyber Cell, Central Division for investigation.

Learned counsel submits that the Cyber Cell, Central Division is equipped to deal with a complaint as the instant one.

In view of the lackadaisical approach of the investigating agency in the present matter and slipshod investigation held in course of almost a year, this Court finds it necessary to transfer the investigation to the Cyber Cell,

Central Division. Accordingly, the Assistant Commissioner of Police, Detective Department, Cyber Cell shall take up the investigation of the case and proceed with the same in accordance with law.

With the above observations and directions, the writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
