Under such circumstances I am not inclined to adjourn the matter suo motu and I propose to dispose of the matter on merit based on materials available with the record.

This criminal revision challenges the proceeding being Golabari Police Station case no. 127 of 2011 dated 12th March, 2011 corresponding to GR case No. 1170 of 2011 pending before the learned Chief Judicial Magistrate, Howrah under Section 498A/323/506/34 of the Indian Penal Code. It is contended that opposite party no. 2, Kiran Singh, depicting herself as legally married wife of Siddharth Singh, the petitioner no.1 herein, informed Golabari Police Station in writing about her plight in her matrimonial home over the demand of dowry. As the

information disclosed offences cognizable in nature, Golabari Police Station case no. 127 of 2011 was registered. It further appears that during pendency of this proceeding, the opposite party no. 2, Kiran Singh and the petitioner no. 1 Siddharth Singh, decided to dissolve their marital knot by filing an application under Section 13B of the Hindu Marriage Act. It further appears that consequent upon such settlement Kiran Singh has withdrawn the proceeding under Section 498A of the Indian Penal Code pending before the learned SDJM, Hazipur in complaint case no. 3059 of 1999.

Under such circumstances I do not find any reason to stand in the way. This proceeding, being GR case no. 1170 of 2011 corresponding to Golabari Police Station case no. 127 of 2011 stands quashed to secure ends of justice.

The criminal revision is thus disposed of.

With the disposal of the criminal revision, the connected application being CRAN 1 of 2016 thus become infructuous and is also disposed of accordingly.
