IN THE HIGH COURT AT CALCUTTA

Criminal Revisional Jurisdiction CRR 1263 of 2024 Gurupada Panja -versus- State of West Bengal & Anr.

Mr. Gobinda Chandra Baidya Mr. Gobinda Baidya .... ..for the petitioner.

Mr. Sudip KUmar Mr. M. F. Begg for the State.

Report submitted by the learned advocate for the State reflects that the process of proclamation and attachment was executed on 12th May, 2024 and 17th May, 2024, when this Court was in seisin of the revisional application at least from 22nd April, 2024.

Having considered that the proclamation and attachment was not earlier executed and was executed during the pendency of the revisional application before this court, I am of the opinion that some respite must be given to the petitioner who approached this Court. Accordingly, proclamation and attachment order so issued and subsequently executed be kept in abeyance and stayed till 20th June, 2024. Petitioner would be at liberty to exhaust the remedy available in law in connection with Harwood Point Coastal P. S. Case No. 434 of 2022 dated 10-10-2022, within the aforesaid period.

Needless to state that the warrant of arrest which has been executed will remain in force and there is no bar for the Police Authorities to execute the same. The learned ACJM, Kakdwip would revive the execution of proclamation and attachment if the petitioner do not appear and/or surrender before the learned ACJM,

Kakdwip by 20th June, 2024.

With the aforesaid observations, the revisional application being CRR 1263 of 2024 is disposed of.

Connected applications, if any, are consequently disposed of. Report so submitted by the learned Advocate for the State be kept with the record.

All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
