Learned advocate appearing for the petitioner submits that there was a free fight and that there is a police complaint lodged at the behest of the petitioner with regard thereto. Learned advocate appearing for the State draws the attention of the Court to the materials in the case diary including the injury report, medical documents relating to the victim suffering abortion as also the statement of the victim recorded under Section 164 of the Criminal Procedure Code. Apparently, the victim had to undergo abortion due to physical assault meted out. Petitioner was involved in the incident of assault.

Considering the gravity of the offence and the involvement of the petitioner in the incident, we are unable to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected. CRM (A) 1053 of 2024 is dismissed.
