Ms. Sabita Khutia (Bhunya) ..for the petitioner Mr. Bibek Jyoti Basu Mr. Uttam Kumar De ..for the State It appears that the petitioner had retired from service as a Gram Panchayat Karmee of Sandelerbill Gram Panchayat, District North 24 Parganas on August 31, 2009. It is alleged that the Pension Payment Order was issued on August 17, 2009 as per ROPA-1998 but the benefits of ROPA-2009 has not yet been given to the petitioner.

The Director of Pension, Provident Fund and Group Insurance is directed to consider the prayer of the petitioner for issuance of the revised Pension Payment Order by implementing ROPA-2009 or any relevant ROPA rules. Such decision shall be taken and necessary Pension Payment Order shall be issued within two months from the date of communication of this order. If the authorities find that the same cannot be given to the petitioner, a reasoned order shall be passed and communicated to the petitioner within the aforementioned period. With the aforementioned directions, this writ petition is disposed of.

There will be, however, no order as to costs. All parties are to act on the basis of the server copy of this order.
