This is an application under Article 227 of the Constitution of India praying for expeditious disposal of O.A. No. 435 of 2011 pending before the learned Kolkata Debts Recovery Tribunal No. 1.

Mr. Chowdhury, learned counsel appearing on behalf of the opposite party nos. 1 and 3, submits that the Tribunal is lying vacant, therefore, direction as prayed for is not warranted at this stage.

Mr. Dasgupta, learned counsel appearing on behalf of the petitioner, on the other hand submits that the Tribunal No. 3 is taking the matters of Tribunal No. 1 being In-charge. On perusal of the records it appears that the Tribunal is proceeding with the matter with a reasonable pace, further acceleration to it is not necessary at this stage, it is however

expected that the Tribunal shall dispose of the said matter as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

C.O. 895 of 2021 is thus disposed of without any order as to costs.

The connected application being IA No: CAN 1 of 2021 is also disposed of accordingly.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
