It is found that there are some disputes with regard to the extent of the petitioners' land. There are proceedings pending before the LRTT in O.A. No. 2176 of 2005 for cancellation of vesting of certain lands, filed by the petitioners.

Counsel for the petitioners submits that in addition to the subject matter of O.A. No. 2176 of 2005, the private respondents, who belong to a particular religious community, have forcibly broken down a wall of the petitioners and have erected a Sign Board "Teghari Biswaspara Eid-Gaha Maidan STD-2020" at the said premises. He further submits that the same constitutes an encroachment under a religious colour.

The petitioner may take out appropriate civil proceedings in that regard.

The Raghunathganj Police Station shall ensure that there is absolutely no breach of peace in the area.

In the event of any further allegations of criminal intimidation or threat, the Raghunathganj Police Station may take steps in accordance with law. With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
