Mr. Somnath Naskar ... ... for the State This writ petition was filed in the year 2015 seeking a direction to the respondents to hand over investigation to the National Intelligence Authority.

The writ petition was filed on the basis of the news published on 4th March, 2015 about the fake currency note and use of metal block to print serial numbers on currency notes stolen from the RBI.

An allegation was made that the Special Task Force was not taking appropriate action and no arrest was made.

In the aforesaid background, a prayer was made for handing over the investigation to NIA.

In pursuance to the previous direction of this Court, the report in the form of communication at the instance of Assistant Commissioner of Police, Special Task Force, Kolkata has been filed, which reveals that during the course of investigation prima facie commission of offence under Sections 120B/489A/489C was found against accused Chandra Sekhar Jaiswal. Accordingly, the charge-sheet on 28.04.2015 was submitted before

the CMM, Calcutta vide CS No.07/15. After obtaining the requisite Sanction from the Government of West Bengal, supplementary charge-sheet under Sections 16/17/18 U.A. (P) Act was submitted against the accused Chandra Sekhar Jaiswal on 01.08.2015. The report further reveals that the trial of the case in Sessions case no.39 of 2015 is presently continuing before the Court of CBI-1, Bichar Bhawan, City Sessions Court, Calcutta and six prosecution witnesses have already been examined. In view of the above, we are of the opinion that the grievance raised by the petitioner does not survive. Hence, the writ petition is disposed of by taking the report on record.
