A direction to secure expeditious disposal of the suit, is the ultimate relief sought for in this case. Admittedly, petitioners have been suffering ad interim order of injunction.

The only contention expressed by the petitioners is against the delay caused in the disposal of temporary injunction application together with the suit.

Learned advocate appearing for the opposite party submits that he has no objection to the expeditious disposal of the injunction application. No other point is raised requiring address by this Court.

Accordingly, learned Civil Judge (Junior Division), 1st Court, Alipore in Title Suit No. 911 of 2017 is requested to ensure expeditious disposal of the pending injunction application under Order 39 Rules 1 and 2 of the C.P.C., providing sufficient

opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.

This would not, however, prevent the Court below to ensure expeditious disposal of the pending suit.

Petitioners are directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties including plaintiff of suit.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
