Learned counsel for the Reserve Bank of India relies upon an e-mail communication made by the bank to the petitioner intimating that a conciliation meeting between the complainant and the regulated entity was scheduled on December 10, 2024 in the Ombudsman's chamber and that the petitioner was requested to attend the same with all necessary documents. As the petitioner failed to appear in the conciliation meeting, the complaint of the petitioner stood closed.

Learned counsel for the State submits, upon instructions received from the Officer-in-Charge of Golabari police station, Howrah dated April 17, 2025 that, in response to the complaint lodged by the petitioner, Golabari PS Case No.187/2024 under sections 406/419/420 IPC was taken up for investigation. One person by the name of Sahid Shekh S/o, Raju Seekh of Ward No.6, Raj

Bari, Jamtara Jharkhand was identified and his bank account was found to be involved in the monetary transactions of the instant case.

Notice was issued to the said Raju Shekh, but the said person did not turn up pursuant to the said notice. The investigating Officer conducted raid at Jamtara for verification and tracing out of the accused, but he is absconding. The investigation of the case is reported to be in progress.

From the submission made on behalf of the parties, it appears that there has not been any deficiency either on the part of the bank or any error on the part of the banking Ombudsman. The police are investigating the complaint lodged by the petitioner.

The police are, therefore, directed to conclude the process of investigation at the earliest.

The writ petition stands disposed of.
