Petitioners Mr. Soupal Chatterjee Mr. Bimal Sil Ms. Madhumita Chatterjee ...for the petitioners Mr. Joydeep Biswas Ms. Debjani Sahu ...for the State Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners have been falsely implicated in this case due to political reason. They did not even know about registration of FIR against them.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She relies on the case diary and points to the post mortem report and to the statements of witnesses and the FIR. The FIR maker was an eye-witness and he named the present petitioners as some of the assailants. The victim died due to gunshot injury. The petitioners have absconded for eight years. While the FIR was registered in 2018, a charge sheet was submitted in 2020. Considering the above and the other incriminating materials available in the case diary and the long absconsion of the present petitioners, I do not consider this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail is rejected.
