PP Mr. Arijit Ganguly Ms. Manisha Sharma ...for the State This is an application seeking an expeditious disposal of a proceeding in which a charge-sheet was submitted under Sections 21 (c) and 29 of the NDPS Act.

Learned counsel for the petitioners submits as follows. The petitioners are the accused in this case. They are in custody since 25.08.2020 the date on which the FIR was lodged. Charge-sheet was submitted in November 2020. 9 witnesses were to be examined in this case. In January, 2021, charges were also framed. In the course of trial, only 4 witnesses have been examined out of a total of 9 witnesses. The proceeding has remained pending for no fault of the present petitioners.

Learned counsel for the State submits that the trial has proceeded quite regularly in this present case.

I have heard the submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition. Considering the fact that COVID-19 had set in in the meantime, it does not appear that an inordinate delay has been caused in this case.

However, it is a still matter of concern that the trial is pending while the petitioners are in custody since 25.08.2020.

In view of the above and in the interest of justice, I request the learned trial Court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of one year from the next date of hearing.

With these observations, the revisional application is disposed of.
