S.De (Rejected) (Via Video Conference) CRM No. 3116 of 2021 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure filed on 06.04.2021 in connection with Berhampore Police Station Case No.1111 of 2019, dated 02.09.2019 under Sections 341/307/34 of the Indian Penal Code and Sections 3 /4 of the Explosive Substances Act.

The case was initiated for attempted murder and offences punishable under the Explosive Substances Act. tHe petitioner says that the charge-sheet has been submitted and the Sections of the Explosive Substances Act have been omitted. Be that as it may, we have seen the material in the case diary. There are witnesses saying that the petitioner was the person who caused explosion of bombs.

We have seen the injury report. Significant injury has been suffered by the victim.

In view of the gravity of the allegation against the petitioner who obviously evaded the police authorities and did not co-operate with the investigation, although, charge-sheet has been submitted, we are not inclined to entertain the petitioner's prayer for anticipatory bail.

Accordingly, CRM 3116 of 2021 is dismissed.
