The alleged contemnor no.1 has filed a compliance report under his seal and signature, the same is taken on record. Copy has been served upon the learned advocate for the petitioner today in Court. The report shows the encroachment is there as alleged by the petitioner.

The alleged contemnor no.2 has also filed a report dated September 9, 2025 in the form a letter written to Mr. Ayan Banerjee, learned advocate, duly signed by him. The report shows

that the alleged contemnor no.2 is not the jurisdictional authority as the land on which an encroachment has been found belong to the National Highway Authority of India (NHAI).

Accordingly, information and record have already been sent before the NHAI. The report is taken on record. Copy has been served upon the learned advocate for the petitioner appearing today in Court.

From the above, it appears that the alleged contemnor no. 1 has complied his part of obligation to carry out the direction of this Court dated September 26, 2024. The alleged contemnor no.2 is not the jurisdictional authority, who can carry out the direction. The stage has not yet come for the alleged contemnor no.3 to comply with the direction of this Court.

In view of the above, the present contempt proceeding does not survive any further.

Accordingly, the contempt proceeding, CPAN 572 of 2025 stands dropped and closed.

However, the petitioner shall be at liberty to institute an appropriate proceeding, if necessary, in accordance with law, if the petitioner is found to be entitled to do so in the eye of law.

CPAN 572 of 2025 stands disposed of, without any order as to costs.
