Mr. Satyam Mukherjee ..for the petitioner In this revisional application, the petitioner prays for expeditious disposal of the application for injunction filed in Title Suit No. 193 of 2020, pending before the learned Civil Judge, Junior Division, 1st Court, Barasat, District North 24 Parganas.

It is submitted that the application is otherwise ready for hearing and the contesting parties have already filed their written objections. It is further submitted that the application for variation and/or vacating of the interim order of injunction under Order 39 Rule 4 of the Code of Civil Procedure is also pending but no objection to the same has yet been filed by the plaintiff.

Under such circumstances, this revisional application is disposed of without going into the merits of the same with a direction upon the learned Court below to dispose of the pending application upon affording an opportunity to all the parties to contest the same by filing their appropriate objections. The said application should

be disposed of within a period of three months from the next date fixed without granting any unnecessary adjournments and the learned Court below shall decide the matters independently and in accordance with law without being influenced by any observations made hereinabove.

This revisional application is disposed of.

The petitioner is directed to serve copies of the revisional application along with the server copy of this order upon the opposite parties and the learned Advocate for the opposite parties in the learned Court below within a week from date.

There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
