C.R.M. (DB) 1128 of 2022 (AD) 12.05.2022 Court No.29 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with G.R. Case No.1926/2016 arising out of Mogra P.S. Case No.121 of 2016 dated 16.04.2016 under Sections 302/120/34 of the Indian Penal Code, being S.T. Case No.14(3)/2017.

And (Rejected) In the matter of: Amit Ram & Anr.

....petitioners.

Mr. Sudip Ghosh Chowdhury ...for the petitioners.

Mr. Madhusudan Sur, Ld. APP Mr. Manoranjan Mahata ... for the State.

Petitioners pray for bail.

Report as called for by the order dated April 28, 2022 filed in Court be taken on record.

It appears from the report that the prosecution was not indolent with the progress of the trial.

It is contented on behalf of the prosecution that out of 24 prosecution witnesses, 21 were already examined. Only 3 prosecution witnesses are left to be examined. There is hardly any material change in circumstances subsequent to the earlier order of rejection. The trial is in progress.

Considering the gravity of the offence, the involvement of the petitioners therein and the materials in the case diary and considering the fact that the trial is in progress, we are unable

to enlarge the petitioners on bail.

Accordingly, the prayer for bail of the petitioners is rejected.

C.R.M. (DB) 1128 of 2022 is dismissed.
