Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Mr. Arijit Ganguly, learned advocate who ordinarily appears for the State. His appointment may be regularised by the concerned authorities. He is entitled to have a junior of his choice.
Mr. Kar, learned advocate appearing for the petitioner draws the attention of this Court to the proceedings under Section 107 of the Code of Criminal Procedure pending before learned Special Executive Magistrate, Barrackpore Police Commissionerate in N.G.R. No. 674/21/5 of 2021 in respect of Khardah Police Station G.D.E. No. 122/21 and 152/21 dated 10.03.2021.
Having considered the time frame which has passed in the meantime and the nature of the dispute involved, I am of the opinion that further continuance of the proceedings because of lapse of time is unwarranted. Accordingly, N.G.R. No. 674/21/5 of 2021 pending before learned Special
Executive Magistrate, Barrackpore Police Commissionerate is hereby quashed.
However, if further incident between the parties recur, the police authorities would be at liberty to take up fresh steps in accordance with law.
With the aforesaid observations, the revisional application being CRR 1018 of 2021 is disposed of. All pending connected applications, if any, are consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
