Learned counsel for the petitioner submits that co-accused almost on the same footing has been granted bail earlier. Chargesheet has been submitted. The petitioner is not the principal assailant. His further detention is not required.

Opposing the prayer for bail, learned counsel for the State submits that the petitioner is one of the assailants who held the victim by his hand after which the principal assailant shot at him.

I have considered the material on record.

The victim, in his statement recorded under Section 164 of Criminal Procedure Code, 1973, has stated that the petitioner and another held him by his hands and the third person shot him.

Considering the involvement of the petitioner in the alleged offence as well as other material available in the case diary, this Court is of the view that this is not a fit case for enlarging the petitioner on bail at this stage Accordingly, the prayer for bail is rejected. The application for bail is thus disposed of. Case diary be returned.

All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties expeditiously after complying with all requisite formalities.
