AND In the matter of:- Dilip Mondal ... petitioner Ms. Baisali Basu ...for the State The present revisional application was preferred in connection with Uluberia Police Station Case No.717 of 2010 dated 30.09.2010, under Section 46(B) of the Bengal Excise Act (corresponding to G.R. Case No.2039 of 2010). The investigating agency, on completion of investigation submitted charge-sheet under the aforesaid Section before the jurisdictional court. At the time of admission of the revisional application on 12.04.2012, although there was a direction to effect service upon the State but it has been categorically observed by the coordinate Bench that no restraint order in the pending proceedings should be passed. Today when the matter has been taken up no information has been furnished before this Court regarding the present stage of proceedings and as the petitioner approached this Court at a prematured stage just after the charge-sheet was submitted and none of the documents under Section 207 of the

Code of Criminal Procedure on which the prosecution proposes to rely has been enclosed with the revisional application, I am of the view that the same was preferred at a prematured stage and as such, no interference is called for.

Accordingly, C.R.R.1136 of 2012 is dismissed. Pending application, if any, is consequently disposed of. All parties shall act in terms of copy of this order downloaded from the official website of this Court.
