Ziaur Rahaman ... for the State-respondent(s) Mr. Ejaz Hossain ... for the private respondent no.4 The petitioner and the private respondents are at loggerheads with respect to a property while the petitioner submits that the private respondent have lost the Preemption case and now are trying to interfere with the peaceful enjoyment of the property.

On the other hand, learned advocate for the private respondent no.4 submits that the petitioner is trying to fill up the water-body and raise a construction.

State has submitted a report which reflects that having regard to the

dispute between the petitioner and the private respondent(s), a proceeding under Section 126/135 of the BNSS have been drawn up vide Haripal P.C. N.C.R. No.

570 of 2025.

In view of the nature of the dispute, the petitioner and/or the respondent(s), if so advised, will approach the civil court so far as the issue relating to right, title, interest, character and possession of the property is concerned.

The police authorities have kept a strict vigil, they would continue with their surveillance and ensure that no breach of peace and/or tranquility takes place as also no untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations, WPA 8009 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
