Visva-Bharati & Ors.
Mr. Raghunath Chakraborty Mr. Supratik Shyamal Mr. Saikat Thakurata .....For the Petitioner
1. Affidavit of service, as filed today on behalf of the writ petitioner is taken on record.
2. At time of hearing, Mr.
Chakraborty, learned counsel for the petitioner has also handed over a printout of the mail dated 22.05.2026 addressed to the respondent authorities expressing therein that the instant matter will be moved today before this Court, which is taken on record.
3. By filing the instant writ petition, the petitioner has challenged correctness and veracity of impugned notice dated 12.02.2026, whereby and whereunder
respondent authorities have published a list of candidates, who have not been shortlisted for the interview by the provisional screening committee.
4. It is submitted by Mr. Chakraborty that despite submission of a representation dated 16.02.2026 with the respondent authorities, a copy of which has been annexed at page-67 of the instant writ petition, no action has been taken by respondent authorities for consideration of the representation of petitioner, though, by a separate notification dated 12.02.2026 [(annexure-'P3' at page-55 of the writ petition], the authorities have clearly indicated that the candidates, who have not been shortlisted, may submit representation within five days through e-mail in the event, they sought for clarification.
5. It is submitted by Mr. Chakraborty that despite submission of
(annexure-'P5'), such representation has not been disposed of.
6. On being asked by this Court, it is submitted by Mr. Chakraborty that the interview of the shortlisted candidates by the provisional screening committee is yet to be completed. On being further asked by this Court, Mr. Chakraborty submitted that the representation was submitted within the time as mentioned in the notification dated 12.02.2026 (annexure-'P3'). In absence of any opposition on behalf of the respondent authorities and since it has been stated on oath that interview of the shortlisted candidates have not yet been completed by the respondent authorities as yet, this Court directs the respondent no. 3 authority to consider the representation dated 16.02.2026, as submitted by the writ petitioner in accordance with law and after giving a fair chance of hearing
to the petitioner and/or his authorised representative and shall pass a reasoned order and shall forthwith communicate the same to the writ petitioner preferably by mail.
7. The entire exercise, as indicated in the foregoing paragraph is to be completed within three working days from the date of communication of the server copy of this order together with a copy of the earlier dated 16.02.2026.
8. The respondent no. 3 authority is directed to act on the server copy of this order.
9. The time-limit, as fixed by this Court is peremptory and mandatory.
10. With aforementioned observations/directions, instant writ petition is disposed of.
11. Before parting with, it is, however, made clear that while disposing of this writ petition, this Court has not gone
into the merits of the instant writ petition and/or dated 16.02.2026 and thus, all points are kept open for adjudication by the respondent no. 3 authority.
12. Urgent photostat certified copy of this order, if applied for, be furnished to parties expeditiously upon compliance of all legal formalities.
