AND In the matter of:- Monosij Roy ... petitioner Mr. Arijit Ganguly, Mr. Saryati Datta ...for the State The present revisional application has been preferred against the proceedings relating to Siliguri Police Station Case No.397 of 2011, dated 11.07.2010, under Sections 406/420/34 of the Indian Penal Code.

At the time of admission of the revisional application although notice was issued but subsequently, the revisional application has not been pursued before this Court.

Records of the revisional application reflect that the petitioner approached this Court at a stage when the charge-sheet has been submitted after completion of investigation.

None of the documents under Section 207 of the Code of Criminal Procedure on which the prosecution proposes to rely has been enclosed along with the revisional application, as such this Court is not in a position to appreciate regarding the manner in which the prosecution intends to prove its case.

Accordingly, this Court is of the view that the revisional application is prematured and as such, no interference is called for.

Hence C.R.R.1139 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. All parties shall act in terms of copy of this order downloaded from the official website of this Court.
