Heard learned advocates appearing for the respective parties.

Petitioner has filed this writ petition being aggrieved by the alleged inaction on the part of the respondent nos.2 and 5 in not deducting the instalment or payment of loan borrowed from the petitioner.

Mr. Rai, learned advocate appearing for the respondent bank submits that to avail the aforesaid claim, petitioner will have to comply with the conditions as per Section 59(1) of the West Bengal Cooperative Societies Act and he opposes the writ petition on other grounds also.

Considering the facts and circumstances of this case and submission of the parties, this writ petition being WPA 7987 of 2023 is disposed of by granting liberty to the petitioner to make appropriate representation before the respondent bank concerned for redressal of his grievance raised in this writ petition within a period of two weeks from date and if such representation is made by the petitioner before the respondent bank concerned within two weeks in that event the respondent bank concerned shall consider and dispose of the same in accordance with law and by passing a reasoned and speaking order after giving an opportunity of hearing to the interested parties within eight weeks from the date of receipt of such representation.

With this observation and direction, this writ petition being WPA 7987 of 2023 stands disposed of. ( Md. Nizamuddin, J.)
