In the matter of : An application under Section 482 of the Code of Criminal Proceudre.

This revisonal application has been preferred in connection with Case NO.C/345/2007 pending before the learned Metropolitan Magistrate, 15th Court, Calcutta under Section 138/141 of the Negotiable Instruments Act. The revisional application was preferred at a stage when the learned Magistrate was pleased to issue execution return of the order of attachment.

Record of this revisinal application reflects that although notice was issued on 11th June, 2012 and date was fixed for hearing on 10th October, 2012 but there was no restrained order in respect of the proceeding pending before court below.

Having regard to the stage at which the petitioners approached this court and the time which has elapsed in the

meantime in the meantime and no information has been furnished before this court regarding the present stage of the proceeding before the learned court below, I am of the view that any interference would prejudice either of the parties at this belated stage.

Accordingly, the present revisional application being CRR 1140 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.
