C.R.M. (NDPS) 429 of 2025 In Re:- An application for bail under section 439 of the Code of Criminal Procedure, 1973 and/or an application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sankrail Police Station Case No. 433 of 2024, dated 16.06.2024 corresponding to NDPS Case No. 07 of 2024 under section 20(b) (ii) (c) of the NDPS Act.

Learned counsel appearing on behalf of the petitioner submits that he has been falsely implicated in this case and he is in custody since 16.6.2024 and the charge has not yet been framed and nobody knows how long it will take to conclude the trial and as such, he may be granted bail on any terms and conditions.

Learned counsel for the State vehemently opposed the prayer for bail contending that 516 kgs. of Ganja were recovered from the vehicle and the petitioner was found working in the vehicle as "Khalasi" and that he has direct involvement with the alleged offence and that the trial would begin shortly and the owner of the vehicle is still absconding and that if he is released on bail, there is every chance of absconsion of the present petitioner.

Having heard leaned counsel appearing on behalf of both the parties and that rigour of Section 37 of the NDPS attracts in the present context, the prayer for bail is considered and rejected.

However, the Trial court is requested to make every endeavour for expeditious disposal of the case after conclusion the trial at the earliest.

CRM (NDPS) 429 of 2025 is accordingly disposed of.
