Learned counsel for the petitioners contends that the petitioners' grievance is inaction on the part of the respondent authorities in taking steps for removal of unauthorized encroachment of public property belonging to the PWD.

Learned counsel for the respondent authorities submits that already the Sub-Divisional Level Road Safety Committee has asked the PWD engineer to initiate proceedings under Section 3(1) of the West Bengal Public Land (Eviction of Unauthorized Occupants) Act, 1962.

Since proceedings have already been initiated, there is no scope of granting any further relief in the present writ petition.

Accordingly, WPA 8682 of 2024 is disposed of with the expectation that the proceedings to be initiated

under Section 3(1) of the 1962 Act shall reach its logical culmination as expeditiously as possible. 5.

The entire exercise should be concluded preferably within six weeks from date.

There will be no order as to costs.

7.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
