Mr. Debashish Roy, ld. PP Mr. Karan Bapuli ... for the State Learned counsel for the petitioner submits that the petitioner is the registered owner of the vehicle. In connection with Islampur PS Case No.1201/24 dated 08.12.2024 under Sections 281/324(4) of the BNS read with Section 139 of the Electricity Act, the petitioner's vehicle was seized. The petitioner prayed for return of the vehicle. By an order dated 03.01.2025 passed by the Special Judge(E), Uttar Dinajpur, the truck bearing No.WB-73 E 6478 together with connected papers was directed to be returned to the registered owner on furnishing bank guarantee of Rs.5 lakhs at any nationalised bank. The petitioner prays for relaxation of such condition.

Learned counsel for the State opposes the prayer. In view of the above and the interest of justice, the amount of bank guarantee is reduced to Rs. 3 lakhs. The impugned order is modified only to this extent.

Accordingly, the revisional application is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
