This is an application for seeking expeditious disposal of the proceeding under section 138 read with section 142 of the Negotiable Instruments Act.

The learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the complainant in this case. He filed the petition of complaint way back in 2014. In 2017 an application for quashing preferred by the accused was dismissed by this Court. Yet, till date the proceeding could not be completed despite the fact that there is a statutory stipulation for an expeditious disposal of a proceeding under section 138 of the Negotiable Instruments Act. Several adjournments have been granted. The matter has remained pending for no fault on the part of the petitioner. I have heard the learned counsel for the petitioner and have perused the revision petition.

No prejudice will be caused to any one if a direction is passed to expedite the proceeding.

It appears that an inordinate delay has been occasioned in this case, especially considering the fact that the proceeding is pending since 2014.

In view of the above and in the interests of the justice, I request the learned Trial Court to conclude the proceedings at the earliest

without granting any unnecessary adjournment to either of the parties, preferably within a period of six months from the next date of hearing.

With the aforesaid observations, the revision petition is disposed of.

Urgent photostat certified copies of this order may be delivered to the learned Counsel for the parties, if applied for, upon compliance of all formalities.
