AGP Mr. Soumen Chatterjee ... for the State-respondent(s) The petitioner is aggrieved by the inaction of the police authorities and, to that effect, approached this Court. There are certain other allegations against the police authorities.

However, I find that consequent to the information furnished by the present petitioner, Karaya P.S. Case No. 29 dated 01.02.2025 was registered for investigation under the relevant provisions of BNS.

Notices have also been served under Section 94 of the BNSS upon the petitioner in respect of supply of certain

documents.

The other accusation made by the petitioner is that the Process Server who went to serve the notice under Section 94 of the BNSS misbehaved and used languages which are uncalled for from a representative of the police authorities. The petitioner further submits that in view of the same, an information was sent through e-mail to the Karaya Police Station.

Be that as it may, so far as the conduct of the Process Server of the concerned police station is concerned, the same is a separate cause of action.

The Officer-in-charge of the concerned P.S. will assess regarding the same after recording the statement of the present petitioner and proceed in accordance with law.

So far as the investigation of Karaya P.S.

Case No.

dated 01.02.2025 is concerned, the same is in

progress.

Accordingly, I direct that the petitioner would obtain necessary documents and cooperate with the investigating officer of the case so that the investigation of the said case may be taken to its logical conclusion within a reasonable period of time.

In case, the petitioner is afraid of any individual or feels insecure because of the act and actions of any person associated with the accused persons, the same be brought to the notice of the jurisdictional court. The jurisdictional court would call for a threat perception report and direct the police authorities to submit a report. On the basis of the said report, necessary directions be passed under the Witness Protection Scheme, 2018.

With the aforesaid observations, WPA 7978 of 2025 is disposed of.

Pending application(s), if any, is

also disposed of.

Since Affidavits have not been invited, other allegations made in the writ petition are deemed not to have been admitted.
