1. This revisional application seeks expeditious disposal of an application for injunction under Order 39 Rule 1 and 2 read with Section 151 of the Code of Civil Procedure filed by the opposite party in Title Suit No.610 of 2018 pending before the learned Civil Judge (Junior Division), 1st Court at Baruipur, South 24-Parganas.

2. Mr. Halder, learned advocate appearing for the petitioner submits that an ad interim order of injunction was passed on the aforesaid application at the instance of the plaintiffs/opposite parties as far as back on January 18, 2019 and the same has been continuing since then. It is submitted that the application for temporary injunction requires expeditious disposal.

3. In view of the nature of the order proposed to be passed, prior service of the revisional application along with a notice is not being directed, however, the petitioner shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite parties within a week from

date.

4. Having heard the learned advocate appearing for the petitioner and having considered the material on record, this revisional application is disposed of by requesting the learned Civil Judge (Junior Division), 1st Court at Baruipur, South 24-Parganas to dispose of the aforesaid application for injunction as expeditiously as possible and preferably within a period of two months from the next date fixed without granting any unnecessary adjournment to either of the parties.

5. The petitioner shall also have liberty to file application for preponement of hearing of the said application. If such application is filed, the learned Trial Court is requested to dispose of the same upon giving notice to the other side.

6. As prayed for, let the order be communicated to the learned Trial Court by way of a Special Messenger, subject to costs for such Special Messenger being put in by the petitioner within a week from date.

7. With the aforesaid observations, CO 1201 of 2026 stands disposed of. No costs.

8. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai, J.)
