Learned Advocate has prayed for expeditious disposal of G.R. case No. 17 of 2022 arising out of Hili Police Station case No. 01 of 2022 dated 03.01.2022.
Learned Advocate submits that initial prayer was for quashing of the proceeding but as the trial has progressed and the examination of investigating officer is in progress, he has modified the prayer to the extent that if the documents in support of the petitioner's contention is brought on record particularly with regard to his citizenship, his purpose would be served. Learned Trial Court will exhaust such process of ascertaining documents at the D.W. stage before arriving at its final disposal. All efforts be taken so that the trial of the case is concluded at the earliest by complying with the aforesaid direction. If the documents have already been checked the learned Trial Court will not deal with such issues but would limit upon the defence to adduce its own evidence to prove its innocence.
With the aforesaid observations, the present revisional application being CRR 1417 of 2022 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
