The petitioner alleges that the respondent nos. 6 to 8 had raised an unauthorized construction on Dag No. 129 of Mouja - Samsabad Sarberia, without any sanction from the permission granting authority. Learned advocate for the respondent nos. 6 & 7 has produced a copy of a sanction plan. It appears that a sanction had been granted by the Kendiamari No. 3 Gram Panchayat sometime in February 2023. It is further submitted that on the basis of such sanction, the construction was being raised.

Nothing remains to be decided in the writ petition. The writ petition is disposed of with a direction upon the respondent authorities to ensure that the construction had been made strictly in accordance with the sanction plan.

However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
