Court No. 6 CO 1229 of 2025 (265719) 14.07.2025 Vaijayanti Roy Vs.

Dr. Sambhu Das (AD 140) (S. Banerjee) Mr. Jyoti Prakash Chatterjee ...for the petitioner Mr. Tilak Mitra ...for the opposite party This application under Article 227 of the Constitution of India is at the instance of the mother and is directed against order no. 13 dated March 4, 2025 passed by the learned Additional District Judge 7th Court at Alipore in Act VIII Case No. 25 of 2025. By the order impugned, the learned trial judge allowed the prayer for visitation of the father for two hours once in a week on every Saturday/Sunday at 4 p.m. as per the convenience of the minor daughter and the petitioner/father shall return the minor daughter to the mother at 6 pm. at the respective days positively. The father was also given liberty to meet the minor daughter virtually on Wednesday at 6 p.m. for 30 minutes and the mother was directed to facilitate such access of the petitioner/father through virtual mode.

Mr. Chatterjee, learned advocate appearing for the petitioner/mother submits that after every visitation the child is getting annoyed.

Heard Mr. Mitra, learned advocate appearing for the opposite party on such submission.

It is the duty of the mother to make the child understand as to what is the role of a father in the development of such minor.

After going through the order impugned, more particularly the directions passed, this court is not inclined to interfere with the order allowing the prayer for visitation of the father.

With the above observation, CO 1229 of 2025 stands disposed of. However, there shall be no order as to costs.
