Despite service of notice, respondents are not represented.

The writ petitioner has been serving as an employee of the BCCL since 1988. In November, 2009 he participated in the process of permanent absorption in the Sales Marketing division of the Coal India Limited. The petitioner was called for an interview and he appeared.

The result of the interview was, however, not published in view of the interim orders passed in W. P. 10404(w) of 2000. By an order dated 6th April, 2011 a Single Bench in the said proceedings directed the respondents to consider the representation of the petitioners in the said writ petition which has not been done till date.

It is submitted that the order dated 6th April, 2011 was carried in appeal being M.A.T. No. 848 of

2011 and the same was stayed by the Division Bench. FMA 1482 of 2011 came to be dismissed by an order dated 17th May, 2018.

The writ petitioner submits that there is, therefore, no impediment in the respondents CIL, declaring the result of the recruitment process in which he had participated in the year 2011.

A representation to this effect has been made by the petitioner on 23rd May, 2018 which is being considered by the Coal India Limited.

In those circumstances, the writ petition is disposed of, directing the respondent no. 2 to complete the recruitment process in the Marketing and Sales Discipline of the Coal India Limited pursuant to Circular dated 10.11.2009 within a period of four months from the date of communication of a copy of this order.

With the aforesaid directions, the instant writ petition is disposed of.

In view of the disposal of the main writ petition, connected application being CAN 3938 of 2020 is also disposed of.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
