Petitioner is directed to serve a copy of the revisional application upon Ms. Das, learned advocate, who ordinarily appears on behalf of the State. Her appointment may be regularised by the concerned authorities.

The present case arose out of Kanksa Police Station Case No.251/2014 and is presently pending before the Judicial Magistrate, 6th Court, Burdwan.

The grievance of the petitioner is that in spite of the direction passed on 21.01.2020 in CRR 2052 of 2019, the trial court is assigning long dates and there has been no progress in the case and no evidence recorded till date. Learned advocate for the petitioner submits that there is delay in trial and as such dates are fixed almost after 6 months.

In view of the evidence which has already commenced, the trial court is directed that henceforth on and from the next date at least once in every 2 months a date be fixed for

examination of the concerned witnesses, so that the trial of the case can be concluded at the earliest.

No unnecessary adjournment should be granted to the parties.

Public Prosecutor conducting the case would make available all the necessary documents, statements, materials and exhibits on the date on which the witness would appear before the court. All stakeholders must cooperate with the court to complete the trial within a reasonable period of time.

Learned magistrate is directed to proceed with the trial of the case in spite of any resolution of the local bar. With the aforesaid observations, CRR 1208 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
