Banerjee) Mr. Raja Biswas Mr. Abhijit Sarkar ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the 4th defendant praying for a direction upon the learned Civil Judge (Sr. Division) 7th Court at Alipore, South 24 Parganas to dispose of Title Suit No. 411 of 2021 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate of the petitioner shall be obliged to forward a copy of this application, along with a copy of this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial Judge.

From the order sheets appended to this application this Court finds that the application under Order 39 Rule 1 and 2 of the Code of Civil

Procedure and an application under Order 22 Rule 3 CPC are pending.

The learned Civil Judge (Sr. Division) 7th Court at Alipore, South 24 Parganas is requested to take up the hearing of the aforesaid applications, if the same are otherwise ready for hearing, and to make an endeavour to see that the said applications are disposed of as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

With the aforesaid observations and directions CO 1231 of 2025 stands disposed of.
