This Court is not inclined to pass any mandatory order for expeditious disposal of Title Suit No.42 of 1990 along with the pending application. The proceedings are pending before the learned Civil Judge (Senior Division), 4th Court at Baruipur, South 24-Parganas.

On an earlier occasion, this Court had directed expeditious disposal of the suit in C.O. No.2250 of 2023 which was filed by the petitioner. Subsequently, the petitioner has filed an application for rejection of the plaint. Thus, the learned court shall proceed in accordance with law and dispose of the said application expeditiously preferably within a period of three months from the next date fixed, independently and strictly in accordance with law, upon allowing the parties to contest the proceeding.

This order shall not be construed as an opinion of this Court on the merits of the application filed by the petitioner and the learned court shall decide on its own merits and in accordance with law.

The revisional application is, thus, disposed of. There will be, however, no order as to costs. Parties are to act on the basis of the server copy of this order.
