Sabita Ghosh & ORS v. State Of West Bengal& ORS
06.10.2020.
WPA 5876 of 2020 jks Ct.
With CAN No.1 of 2020 (Old CAN 3970 of 2020) (Via Video Conference) Sabita Ghosh & Ors.
Vs The State of West Bengal & Ors.
Mr. Amar Nath Sen, Mr. Malay Dhar, ... For the Petitioners.
Ms. Chaitali Bhattacharyya, Mr. Mrinal Kanti Ghosh, ...For the State.
Mr. Sen, learned Counsel appearing for the petitioners submits that the petitioners are working as 'Anganwadi Helper'
on monthly remuneration. The petitioners were surprised to receive an intimation from the Child Development Project Officer, Sonamukhi ICDS Project, PostSonamukhi, District-Bankura, being the respondent No.7 in this instant application and being Memo No.54/ICDS/SONA dated 6th March, 2020, wherein it was stated that according to the resolution of the meeting dated 4th March, 2020 the Sub-divisional Officer, Bishnupur has terminated the petitioners from their respective Anganwadi Center with effect from 6th March, 2020, though it was specifically mentioned in the engagement letter that prior to termination, the respondent authorities would give
one months prior notice. Learned Counsel appearing for the petitioners further prays for quashing of the letter dated 6th March, 2020 on this score alone.
Ms.
Chaitali Bhattacharyya, learned Counsel appears for the State.
Heard both the parties.
It is crystal clear that though the engagement letter dated 22nd August, 2019 is categorical on the issue that prior to termination, the respondent authorities would give one months prior notice to the petitioners, the letter dated 6th March, 2020 does not reflect that the petitioners were given one months prior notice before termination and as such I quash the notice dated 6th March, 2020 issued by the Child Development Project Officer, Sonamukhi ICDS Project, Sonamukhi, Bankura.
WPA 5876 of 2020 along with CAN 3970 of 2020 is, accordingly, disposed of.
Since no affidavits have been invited, the allegations contained in the writ petition are deemed not to have been admitted by the respondents.
There will be no order as to costs.
The parties shall act in terms of the copy
of the order downloaded from the official website of this Court.
