The petitioner filed a suit for divorce and the wife/opposite party herein entered appearance after service of summons and it is only after the written statement was filed the petitioner has filed that application.

The learned advocate appearing for the petitioner submits that the opposite party did not put her signature in the written statement.

The learned trial judge was right in holding that merely on the basis of such allegation, the suit could not have been directed to proceed ex parte.

This court does not find any infirmity in the order impugned warranting interference under Article 227 of the Constitution of India.

Accordingly, CO 1232 of 2025 stands disposed of.
