Heard the learned counsels appearing on behalf of the petitioners and the State.

It appears that an erroneous submission was advanced on behalf of the petitioners on the previous occasion. As would appear from the order dated 11.04.2025, it was submitted on behalf of the petitioners that the victim gave an exonerative statement before the learned Magistrate. This is not correct.

The charge sheet only reflects that there was no allegation of sexual assault made by the victim in her statement made before the Magistrate. However, the victim in her statement before the Magistrate had made serious allegations against the present petitioners. There, among other things, it was stated that real name of the petitioners were different. The victim came to know about it when the petitioners took her to a place at Salt Lake. They were involved in trafficking of women. She was forcibly married off to the one named Subhankar Jana @ Sayan and thereafter, a ransom call was given to her father demanding Rupees Two Lakhs. In view of the incriminating materials present in the case diary, a prima facie case is made out against the petitioners. Accordingly, the revisional application for quashing is dismissed, however, without any order as to costs.
