Petitioner has approached this court for quashing of Topsia PS Case No. 105 dated 30.07.2024.

Learned advocate appearing for the petitioner contends that the accusations are motivated. The police authorities have failed to show any transaction or seize any documents which would reflect that the petitioner was at all involved in any offence. The very purpose of the case was only after the petitioner has resigned from his job.

Mr. Karan, learned advocate appears on behalf of the State and submits that the

investigation of the case is in progress since July 2024 and the police authorities are in the process of collection of materials to take the investigation of the case to its logical conclusion.

Learned advocate for the defacto complainant submits that he has not been made a party in a case where quashing has been sought for. Mr. Bhattacharya, learned advocate appearing for the defacto complainant has been heard on the issues relating to principles of quashing of the FIR. Be that as it may, having considered the stage at which the petitioner has approached this court, I am of the view since investigation has already been carried on for 9 months, petitioner if so advised will approach this Court at the appropriate stage of the proceeding after the investigation is taken to its logical conclusion and the documents relied upon by the prosecution is served upon the petitioner.

With the aforesaid observations WPA 7885 of 2025 is disposed of.
