Lakshman Prasad Dey v. The State Of West Bengal And ORS.
M/L 804 17.07.2025 Bpg.
ct.no.35 W.P.A.8710 of 2024 Lakshman Prasad Dey
Versus
The State of West Bengal & Ors.
Mr. K.J. Yusuf Mr. Parikshit Goswami.
...for the State-respondents.
Records of the writ petition reflect that the petitioner has approached this Court for obstructions being raised at the behest of the private respondent in respect of construction of house under the Pradhan Mantri Abas Yojana Scheme.
To that effect, information was furnished with the police authorities, but no steps have been taken. The writ petition also reflects that a civil suit being T.S.56 of 2020 is pending before the learned Civil Judge (Senior Division), Ghatal which was at the behest of the private respondent.
Be that as it may, police authorities have hardly any scope in respect of issues relating to dispute over a land until and unless they are called upon to interfere in the law and order crisis. State has submitted a report. Report reflects that the Officer-in-Charge, Chandrakona has kept a sharp vigil and maintained peace at the area, I direct
that the same surveillance be continued and the police would oversee that no untoward incident results because of the strained relationship existing between the petitioner and the private respondent. With the aforesaid observations, WPA 8710 of 2024 is disposed of.
There will be no order as to costs.
Report so submitted be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
