The petitioner complains that at the instance of the Pradhan, Ichhapur Gram Panchayat construction was being made upon the private land of the petitioner. The petitioner lodged complaint before the District Magistrate, Paschim Bardhaman, Asansol in September 2019.

The B.L. & L.R.O. was directed to enquire into the matter by the Sub-Divisional Land & Land Reforms Officer, Durgapur. A report of the Revenue Officer has been annexed to the writ petition addressed to the B.L. & L.R.O. Further direction was given by the SubDivisional Magistrate, Durgapur for furnishing of the detailed report.

The petitioner has annexed the record-of-rights in respect of the plot of land which mentions that the petitioner is the raiyat of the Dag No. 1956. As it appears that the matter is pending before the Block Development Officer for a considerable period of time and the grievance of the petitioner is yet to be redressed, accordingly, the Court thinks it fit to direct the District Magistrate, Paschim Bardhaman to consider the prayer of the petitioner which was submitted in the office of the District Magistrate & Collector in September 2019.

The District Magistrate shall cause an enquiry to ascertain the allegation that has been raised by the petitioner.

A reasonable opportunity of hearing shall be given by the District Magistrate to all the concerned parties. reasoned order shall be passed and communicated to the parties at the earliest.

The District Magistrate shall ensure that the grievance of the petitioner is redressed positively within a period of twelve weeks from the date of communication of a copy of this order.

The petitioner is directed to forward a copy of the representation submitted in the office of the District Magistrate, Paschim Bardhaman in September 2019 along with all other documents in support of his claim to the aforesaid respondent at the time of communicating the order of this Court.

The writ petition stands disposed of.
