The petitioner as the sole defendant in Title Suit No.135 of 1992 pending before the learned Civil Judge (Senior Division), Katwa, Purba Burdwan, prays for expeditious disposal of the said suit.

It is submitted that the arguments in the suit have been going on since 2017, but the suit has not yet been concluded and presiding officers were transferred in between. The defendant in the suit, has suffered irreparable loss and injury due to the inordinate delay in the conclusion of the suit. The order sheet annexed to the revisional application justifies the prayer of the petitioner seeking expeditious disposal of the suit, which is at its final stage of arguments.

This Court has not gone into the merits of the suit. An order of expeditious disposal of any litigation enures to the benefit of all the parties and hence prior service of this revisional application upon the opposite party is not required. The prayer is innocuous.

Under such circumstances, this Court directs the learned Civil Judge (Senior Division), Katwa, Purba Burdwan

to dispose of the Title Suit No.135 of 1992 within a period of four months from the next date fixed, without granting unnecessary adjournments to either of the parties. Accordingly, the revisional application is disposed of. However, there will be no order as to costs.

Petitioner is directed to serve a copy of the revisional application upon the opposite party, along with the server copy of this order.

Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
