Petitioner is aggrieved by the fact that the private respondents are trying to encroach upon the petitioner's property and thereby raise construction. To that effect, information was furnished to the police authorities, but no action has been taken. Petitioner further claims that there has been a decree in his favour from the civil court.

Learned advocate appearing for the State submits that the proceedings are pending before the WBLRTT.

Having regard to the fact that the civil court as well as the WBLRTT are in seisin of the issues so far as the right, title and interest of the property is concerned, the same are to be considered by the tribunal and/or the civil court. So far as the police authorities are concerned, they would ensure that

there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the inimical relationship existing between the parties. With the aforesaid observations WPA 9787 of 2025 is disposed of.
