Mal Mr. Debabrata Roy ..for the opposite party This revisional application has been filed by the petitioner praying for expeditious disposal of the Matrimonial Suit No. 1913 of 2017, pending before the learned Additional District Judge, VIIth Court, Barasat, District North 24 Parganas.
Record reveals that the matrimonial suit is at the stage of evidence of the opposite party. The record further reveals that there has been a direction for expeditious disposal of the suit.
Having considered the rival contentions of the respective parties, in my opinion, justice would be subserved if the Matrimonial Suit is disposed of within a period of four months from the next date fixed without granting any unnecessary adjournments to either of the parties.
It is made clear that this order shall be
operative subject to the husband making timely payment of the maintenance pendente lite, as directed by the learned Court below.
This Court has not gone into the merits of the case and the learned Court below shall decide the suit independently and in accordance with law without being influenced by any observations made hereinabove. The learned Advocate for the husband has handed over two demand drafts for the wife and the child towards maintenance for the month of March, 2021. The said demand drafts are accepted without prejudice to the rights and contentions of the parties.
This revisional application is disposed of.
There will be however no order as to costs.
Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
