This is an application seeking an expeditious disposal of a proceeding in which a charge sheet was submitted under Sections 406 and 498A read with Section 34 of the Penal Code.
Let a copy of this application be served upon Mr. Imran Ali and Md. Kutubuddin, learned Counsels who ordinarily appear on behalf of the State. Let them represent the State. Their engagement may be regularised by the competent authority of the State in due course. Learned Counsel appearing on behalf of the petitioners submits as follows. The petitioners are the accused in this case. The petitioner nos.2 and 3 are senior citizens. A charge sheet was submitted on 05.02.2021. There are three witnesses to be examined by the prosecution. On 11.11.2021, charges were framed. Yet, till date, not a single witness could be examined in this case. The matter has remained pending for no fault on the part of the present petitioner.
Learned Counsel appearing on behalf of the State submits that the no inordinate delay has taken place in this case. I have heard the submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition.
For an FIR that was lodged in December, 2019, a charge sheet was filed by 2021 and charges were framed in November, 2021. As such, I
do not find that an inordinate delay has taken place in dealing with the matter.
However, it is expected that the learned Trial Court will conclude the trial as expeditiously as possible.
With the above observations, the revisional application is disposed of.
