A direction to secure expeditious disposal of suit (T. S. No. 51 of 2015) pending before the learned Civil Judge (Junior Division), 2nd Court at Burdwan, is ultimate relief sought for in this case.
Upon adverting to order dated 17th March, 2021 passed in C.O. 571 of 2021, learned advocate appearing for the petitioner submits that despite the direction passed by this court, requiring the court below to ensure expeditious disposal of a pending suit within the period, as stipulated over there, the suit has not yet been disposed of.
The only contention expressed by the learned advocate for the petitioner is against the delay caused in the disposal of the suit.
No other point is raised requiring address by this court.
In view of the nature of order proposed to be made, prior service of notice is considered to be not necessary.
Service upon the opposite party stands dispensed with.
Accordingly, learned Civil Judge (Junior Division), 2nd Court at Burdwan in T.S. No. 51 of 2015 is requested to ensure expeditious disposal of the suit expeditiously, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.
While endeavoring such exercise, this court believes and reposes confidence upon the Trial Court that the logical conclusion of the suit may be reached expeditiously, upon sensing the message already conveyed in CO 571 of 2021.
Petitioner is directed to make communication of this order to the opposite party and his learned advocate appearing in the court below.
With this direction and observation, the revisional application stands disposed of.
Urgent photostat certified copy of this order, may be supplied to the parties expeditiously, if applied for.
