Mrs. Manisha Sharma Mr. Md. Ejaz Akhtar ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the former husband of the prime victim in this case. The marriage between the two was dissolved. Thereafter on one day, the petitioner along with his friend visited the victim's place. It is alleged that after an altercation, the petitioner and his friend poured acid into the mouth of the prime victim/former wife. No such incident actually happened. The petitioner is absolutely innocent. A Division Bench of this Court had granted bail to the co-accused. Learned counsel appearing on behalf of the State submits as follows. The victim/former wife had to remain admitted in hospital due to acid poisoning for about four days. There was another accused who suffered scalp injury. He was admitted in the hospital for a day.

The co-accused referred to was not the prime accused and he was granted bail after a few days of custody. In view of the materials available in the case diary, I do not find this to be a fit case for granting anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected. (Jay Sengupta, J.)
