Petitioner is directed to serve a copy of the revisional application upon Mr. Mirza Firoz Ahmed Begg, learned Advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Petitioner has challenged the continuance of Murarai Police Station case No. 27 of 2020 dated 14.02.2020 under Sections 406/409 of the Indian Penal Code.

Records reflect that the case was initiated on the basis of a complaint lodged by the B.D.O., Murarai-I. On conclusion of the investigation charge-sheet has already been submitted. Having regard to the nature of the allegation for which the investigation was initiated and the police authorities have come to their finding regarding offence being made out and taking into account the stage at which the petitioner approached this Court and the documents under Section 207 of the Cr.P.C. are yet to be supplied to the petitioner. I grant liberty to the petitioner to take up all the issues advanced in the present revisional application at the

stage of consideration of charges. Needless to say that the learned Trial Court would independently arrived at its finding without being influenced by any observation as made by this Court. With the aforesaid observations, the present revisional application being CRR 1422 of 2022 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
